Export Control Rules 2021 – Proposed amendments

Public consultation on proposed amendments to the Export Control Rules 2021 for animals, meat, organic goods, plant, poultry, rabbit and ratite and wild game has closed.

The department received 15 submissions on the proposed amendments to the Export Control Rules 2021 over the consultation period between 1 and 30 November 2021.

The feedback included limited requests for changes, indicating broad stakeholder support for the proposed amendments.

The department made minor changes to the proposed amendments in response to the feedback.

Nine of the submissions received have been published on this page. The remaining submissions are confidential.

Background

Australia’s agricultural export legislation underpins our reputation as a supplier of safe and reliable food and other products. It also assures our trading partners that Australian exports meet their requirements.

A new legal framework for agricultural exports commenced on 28 March 2021, comprising:

  • Export Control Act 2020 (the Act) which sets out the overarching legal framework for the regulation of exported goods including food and agricultural products from Australia.
  • Export Control Rules 2021 (the Rules) which are legislative instruments that set out the operational requirements that must be met to export specific goods from Australia.

The department proposed amendments to the Export Control Rules 2021 and conducted public consultation on these amendments between 1 and 30 November 2021.

The amendments were contained in the Export Control Legislation Amendment (2021 Measures No. 1) Rules 2021.

These amendments addressed issues raised by stakeholders, ensured the legislation remained fit for purpose, corrected minor typographical errors and implemented previously agreed policy.
